Declaration of Restrictions (CC&Rs)

The Board of Directors is taking on the challenge of overhauling the Declaration of Restrictions (CC&Rs). We understand that this could be a lengthy process with cost associated.

  • Why is it necessary?  The main reason for changing the CC&Rs is because laws have changed over the last 16 years. The CC&Rs are so out of date they are confusing and not aligned with the Arizona Revised Statutes.
  • What is it going to cost?  Making an actual change to the CC&Rs is an expensive process. The board will need to consult an attorney for professional advice in order to make a reasonable business decision. It will also need to send out a mailing informing homeowners of the proposed change, hold a town hall type of meeting to discuss the proposed change, and have to send out the ballots to vote.
  • How long will it take?  The time it takes to change the CC&Rs really depends on the homeowners association. If the community is active and will respond it could be a quick process. 

Reporting Alleged Violations

Per the revised Arizona Law (A.R.S. 33-1803) any complaint related to a violation lodged with the Association will NOT remain anonymous. The person lodging the complaint and alleged violation must state his/her first and last name, the date the violation occurred and the provision of the community documents allegedly violated. The law requires that this information must be available to the party who is accused of the violation.
