Thanks to all of those Members who provided suggestions regarding the Amended and Restated Declaration. The Board received valuable input regarding the new governing document.
The Board of Directors is now asking for and recommending your approval of the Amended and Restated Declaration. Therefore, please sign and complete the Written Consent to the Amended and Restated Declaration.
For the lots owned by individuals, all owners of the lot must sign the Written Consent if you wish to approve the Amended and Restated Declaration. Thus, for example, if both spouses own your lot, both spouses must sign the Written Consent. For lots owned by a trust, partnership, limited liability company, corporation or other entity, please be sure to indicate the name of the entity and the capacity in which you are signing on behalf of such entity, e.g. XYZ Trust, by Jane Doe, Its Trustee. The Written Consent provides signature lines, which will make it easy for you to sign the page appropriately.
The Original Declaration requires that at least three-fourths (3/4) of the lots to consent to the Amended and Restated Declaration for it to be approved. Thus, we will need at least 204 lots to consent to and return signed Written Consents for the Amended and Restated Declaration to be approved. Upon the Board's receipt of the required number of Written Consents, the Board will record the Amended and Restated Declaration in the office of the La Paz County Recorder at which time the document will become effective. We will notify you when the document is recorded.
The Board would like to complete this process as soon as possible, so please return your signed Written Consent at your earliest opportunity. Instructions for returning the Written Consent are included on the Written Consent. If you have any questions regarding the completion and signing of the Written Consent or the provisions of the Amended and Restated Declaration, do not hesitate to contact a Board member.
